What's an acceleration claim?
Acceleration claims in construction are claims for payment made by contractors when a project has been accelerated, commonly known as work that is sped up through the timeline to achieve a desired completion time before the deadline. This claim should seek compensation for overtime payment, change of orders, adding to the workforce, speeding of delivery of materials, increasing workloads, and more.
Different types of acceleration claims
There may be a requirement for acceleration for any number of reasons. Additionally, the ability to recoup the cost of expedited work will partly depend on the reasons for the acceleration. There are commonly 3 types of acceleration claims:
Voluntary Acceleration:
Voluntary acceleration occurs simply when the contractor of the project decides to voluntarily accelerate their own work. Due to the nature of this acceleration, the contractor would not be entitled to additional pay or claims.
Directed Acceleration:
Directed acceleration occurs when a contractor is directed to accelerate the project. It’s understood that since the need for a project to have an accelerated schedule funds will be provided for compensation.
Constructive Acceleration:
Constructive acceleration is a situational-based acceleration. If a contractor is delayed within reasonable circumstance, i.e. delayed delivery, and is refused an extension of time, the contractor must accommodate their timeline to catch up with works.
